Unele aspecte ale digitalizării dreptului penal, prin prisma digitalizării infracțiunilor electorale [Articol]

Abstract

The article highlights the trend of digitalization of the process of elaboration, realization and application of the law, which according to the conditions imposed by COVID-19, becomes a necessity. The preconditions and necessary steps for efficient digitization are outlined. We follow the example of art.388 of the Criminal Code of Romania, which criminalizes fraud in electronic voting, as an example of the digitization process. Digitization is done to facilitate legal processes, in which costs, procedures, prudence in cooperation with artificial intelligence, interoperability and protection of citizens’ rights must be considered.
