SUBIECTUL INFRACŢIUNILOR PREVĂZUTE LA ART. 307 CP RM

Abstract

This article is part of the category of scientific research belonging to the field of Criminal Law Special Part. The object of the investigation is the analysis of the subject of the crime provided in art. 307 of the Criminal Code of the Republic of Moldova. Among other things, it is pointed out that the subject of this crime must possess, in addition to a certain intellectual and volitional development stage, a certain professional maturity; or, it is impossible for a 16-year-old person to evolve as a subject of the examined crime. It is also concluded that the investigating judge may fall under the incidence of art. 307 of the Criminal Code of the Republic of Moldova, but only in the case of pronouncing the adopted acts. At the same time, other aspects are analyzed, especially related to the responsibility of the subject of the crime and his special quality: that of judge.
