LATURA SUBIECTIVA A INFRACTIUNILOR DE NEGLIJENTA IN SERVICIU(ART. 329 CP RM)

Abstract

Studiul efectuat are drept scop identificarea laturii subiective a infracţiunilor de neglijenţă în serviciu (art.329 CP RM). S-a demonstrat că imprudenţa este forma vinovăţiei care caracterizează infracţiunile prevăzute de art.329 CP RM, dar nu şi intenţia, deşi acest lucru nu este prevăzut explicit în textul normei de incriminare. Maniera legislativă de descriere a laturii subiective în conţinutul art.329 CP RM creează probleme la determinarea modalităţii concrete a imprudenţei pe care trebuie să o manifeste făptuitorul pentru imputarea neglijenţei în serviciu. În pofida acestui fapt, s-a ajuns la concluzia că făptuitorul poate acţiona atât cu încredere exagerată, cât şi din neglijenţă. Totuşi, în vederea eliminării eventualelor probleme în aplicarea art.329 CP RM, din perspectiva aflării conţinutului laturii subiective a infracţiunilor de neglijenţă în serviciu, sunt formulate unele propuneri legislative menite să ducă la îmbunătăţirea textului art.329 CP RMThe study aims to identify the subjective side of the offences of negligent performance of duties (art. 329 PC RM). It has been demonstrated that imprudence is the form of the guilt that characterizes the offenses provided to art. 329 PC RM, but not the intent, although this is not explicitly provided in the text of the incrimination norm. The legislative way of describing the subjective side in the content of art. 329 PC RM creates problems in determining the concrete form of the imprudence that the perpetrator must manifest for imputation of negligent performance of duties. Nevertheless, it was concluded that the perpetrator can act both with exaggerated confidence and negligence. However, in order to eliminate potential problems in the application of art. 329 PC RM, from the perspective of finding out the content of the subjective side of the offenses of negligent performance of duties in the service, some legislative proposals are formulated to improve the text of art. 329 PC RM.
