ANALIZĂ CRITICĂ PRIVIND CONFORMITATEA art.1071 CC RM MODERNIZAT CU LINIILE DIRECTOARE ALE DIRECTIVEI 93/13/CEE ÎN DOMENIUL PROTECȚIEI CONSUMATORILOR ÎN CONTRACTELE DE CREDIT BANCA

Abstract

În prezentul articol ne propunem să analizăm dacă prevederile introduse în art.1071 din Codul civil al Republicii Moldova modernizat sunt conforme cu rațiunile adoptării Directivei 93/13/CEE și care sunt consecințele juridice ale acestei stări de fapt. De asemenea,vom supune analizei unele exemple prin care aplicarea art.1071 CC RM modernizat ar putea duce la concluzii contradictorii.The purpose of this article is to analyze whether th e provisions introduced in art. 1071 of the modernized Civil Code of the Republic of Moldova, are in line with the reas ons of adopting Directive 93/13/ EEC and what are the legal consequ ences of this state of affairs. We also intend to carry out an analysis of several examples where the application of art.1071 CC RM modernized could lead to contradictory conclusions.
