GARANŢIILE PROCESUAL-CIVILE ALE RECLAMANTULUI LA EXAMINAREA CAUZEI ÎN LIPSA PÂRÂTULUI

Abstract

Tradiţional, examinarea cauzei în lipsa pârâtului este asociată cu condiţia de vulnerabilitate a pârâtului absent, astfel cercetătorii concentrându-şi atenţia pe spectrul de garanţii oferite pârâtului, menite să com- penseze şi, totodată, să balanseze condiţia juridică a pârâtului, determinată de lipsa acestuia din proces, încercând să o echilibreze cu condiţia juridică privile- giată a reclamantului prezent la proces.În această lucrare ne propunem scopul să deplasăm focarul atenţiei de pe pârâtul absent şi să ne concentrăm pe spectrul de garanţii puse la dispoziţia reclamantu lui prezent, pornind de la ideea că reclamantul prezent la examinarea cauzei este expus în egală măsură unui grad de vulnerabilitate condiţionată de lipsa pârâtului, motiv pentru care considerăm necesară cercetarea şi identificarea garanţiilor puse de legiuitor în beneficiul şi apărarea drepturilor şi intereselor reclamantului.Traditionally the examination of the case in the absence of the defendant is associated with the vulnerability condition of the absent defendant, therefore the researchers mostly focus on the spectrum of guarantees offered to the defendant, aimed at compensating and balancing the legal condition of the defendant, determined by his absence from the trial, thus trying to balance his legal state with the privileged legal condition of the plaintif present at the trial. In this paper we intend to move the focus of our attention from the absent defendant and focus on the spectrum of the guarantees made avai- lable to the present plaintif, starting from the idea that the present plaintif, when the case is examined in the absence of the defendand, is equally vulnerable to the defendant’s absence, which is why we consider it necessary to research and identify the guarantees made available by the legislature for the benefit and defense of the plaintif’s rights and interests.
