PARTICIPAREA LA EXAMINAREA CAUZEI CIVILE: DREPT SAU OBLIGAȚIE?

Abstract

Prezenţa părţilor la examinarea cauzelor civile constituie un subiect de discuţii doctrinare, dar şi legale îndelungate, fiind abordări şi poziţii diametral opuse, inclusiv la nivelul legislaţiilor naţionale. Totuşi, participarea la examinarea cauzelor civile este un drept al părţilor sau o veritabilă obligaţie legală? În cadrul prezentei lucrări vom încerca să oferim un răspuns la această întrebare, argumentând poziţia prin prisma conceptelor de drept şi obligaţie subiectivă, precum şi prin coliziunea principiilor contradictorialităţii şi disponibilităţii.Participation in civil trial is a subject of long-standing doctrinal and legal discussions, with diametrically opposed approaches and positions, including at the level of national legislations. However, is participation in civil trial a right of the parties, or a genuine legal obligation? In the present article we will try to answer this question by arguing the position in terms of the concepts of subjective obligation and subjective right, as well as by the collision of the principles of contradictoriality and availability.
