FINALITATEA ȘI PERSPECTIVELE ALĂTURĂRII LA APEL

Abstract

În conformitate cu art.361 CPC RM, coparticipanţii (coreclamanţii, copârâţii) şi intervenienţii care participă în proces din partea apelantului se pot alătura la apel, dacă pretenţiile lor coincid cu pretenţiile apelantului, prezentând o cerere scrisă. Pentru cererea de alăturare la apel nu se plăteşte taxă de stat. În cele ce urmează vom analiza în detaliu cererea de alăturare la apel ca în final să formulăm o concluzie referitor la finalitatea și perspectivele acestei instituții.According to Article 361 of the CPC of the RM, the co-participants and the third parties participating in the process on the appelants side can join the appeal if their claims coincide with the appelant's claims, submitting a written request. No state fee is payable for the request to join the appeal. Further, we analize it in detail to finally conclude on the purpose and the perspectives of this institution.
