Abstract

The free movement of capital is one of the four fundamental freedoms of the European Union’s single market, the others being the free movement of goods, the free movement of services and the free movement of persons. The free movement of capital is the most recent fundamental freedom, as it became a directly applicable freedom only through the Maastricht Treaty, but also the most extensive, as it also includes third countries. The free movement of capital is the foundation of the single market and complements the other three freedoms. Currently, Article 63 TFEU prohibits all restrictions on payments and the movement of capital between Member States and between Member States and third countries.
