Abstract

In the current economic context, businesses face significant challenges, particularly in evaluating their value and managing crisis situations such as insolvency. Within this framework, the concept of an enterprise extends beyond financial aspects to include the unique patrimony it possesses. The sale of this patrimony becomes a complex process that requires a detailed analysis of its legal and economic implications. This article examines the regulation of the sale of an enterprise as a unique patrimonial complex within insolvency procedure in the Republic of Moldova and Romania. It identifies the conceptual and regulatory differences between the two legal systems, as well as the effects of this form of asset realization on creditors, debtors, and the broader economic cycle.
