Обязательная юридическая помощь физическим и юридическим лицам в Республике Молдова на современном этапе

Abstract

Instituția asistenței juridice obligatorii este o instituție juridică menită să asigure egalitatea de șanse pentru cetățeni în realizarea dreptului lor la un proces echitabil. Aceasta a fost cunoscută în dreptul roman, iar în prezent există în sistemele juridice din majoritatea țărilor. În sistemul juridic al Republicii Moldova, instituția asistenței juridice obligatorii este o instituție interramurală, care face parte dintr-o instituție juridică mai mare de asistență juridică garantată de stat, creată în 2007, odată cu adoptarea Legii privind asis-tența juridică garantată de stat. În acest articol, autorii analizează normele juridice care împreună constituie instituția juridică a asistenței juridice obligatorii, identificând elementele structurale ale asistenței juridice obligatorii și caracterizând fiecare dintre aceste elemente. The institution of compulsory legal assistance is a regulatory legal institution designed to ensure equality of opportunity for citizens in realizing their right to a fair trial. It was already known in Roman law, and nowadays it exists in the legal systems of most countries. In the legal system of the Republic of Moldova, the institution of compulsory legal assistance is an inter-branch institution, which as a structural entity (sub-institute) is part of a larger legal institution of state-guaranteed legal aid, created in 2007 with the adoption of the Law on state-guaranteed legal aid. In this article, the authors analyses the legal norms that together constitute the legal institution of compulsory legal assistance, identifying the structural elements of compulsory legal assistance, and characterizes each of these elements.
