Renunțarea de bună voie de la săvârșirea infracțiunii a coautorului

Abstract

The article is dedicated to some aspects related to the voluntary abandonement of the commitment of the criminal offence in the case of the commission in participation, being, in particular, a co-author. Concerning the co-author, we observed that special legal norms are not contained in the Criminal Code of the Republic of Moldova, probably for the reason that in the case of voluntary abandonement of the criminal offence, the legislator considers that the same of rules qualification whichare applied to the co-author. For the elaboration of the article, the existing doctrinal material, the national legislation and some normative sources of other states, relevant to the exposed subject, have been analyzed. The methods used are the analysis and synthesis of scientific and normative sources. As a result of the research, we can conclude that regarding the abandonement of the co-author from committing the crime, art.56 Criminal Code of the Republic of Moldova must be amended.
