DEZLEGAREA UNOR CHESTIUNI CONTROVERSATE PRIVIND CONCURSUL DINTRE SUSTRAGERE ȘI TĂIEREA ILEGALĂ A VEGETAŢIEI FORESTIERE

Abstract

The purpose of this article is to establish the hypothesis in which the offense, provided by the art. 231 of the Criminal Code of the Republic of Moldova, can form cumulation with the appropriation of the resulting wood mass. The logical method and the systemic method were applied to achieve this purpose. The following results were obtained: the determination of the hypothesis in which becomes possible the real cumulation between the offense, provided by the art. 231 of the Criminal Code of the Republic of Moldova, and one of the offenses provided by the art. 186-188, 190 or 191 of the Criminal Code of the Republic of Moldova; demonstrating the impossibility of the ideal cumulation between the offense, provided by the art. 231 of the Criminal Code of the Republic of Moldova, and one of the offenses provided by the art. 186-188, 190 or 191 of the Criminal Code of the Republic of Moldova, etc.
