DELIMITAREA LACUNELOR ÎN DREPT DE ALTE FENOMENE ŞI SITUAŢII ÎN CADRUL PROCEDURII DE APLICARE A DREPTULUI

Abstract

În procesul de aplicare a dreptului, inevitabil ne ciocnim de un așa fenomen cum este lacuna în drept. Mulți consideră că lacuna în drept reprezintă o eroare a legiuitorului în procesul legiferării și aceasta evidențiază calitatea actului de legiferare. Nu suntem de acord cu o asemenea abordare, deoarece diagnosticarea acestui „fenomen” este posibilă doar în procesul de aplicare a dreptului, situație pe care încercăm s-o analizăm.In applying the law inevitably we encounter a phenomenon such as lacuna in law. Many believe that the gap in the law is a failure of the legislature in the enactment and it highlights the quality of regulation. We disagree with this approach, because the diagnosis of this “phenomenon” is possible only in the application of law, we try to analyze the situation.
