CONSIDERENTELE RATIFICĂRII PROTOCOLULUI NR. 16 LA CONVENȚIA EUROPEANĂ A DREPTURILOR OMULUI DE CĂTRE REPUBLICA MOLDOVA

Abstract

Uniformizarea standardelor de protecție a drepturilor omului este unul dintre scopurile principale ale Curții Europene a Drepturilor Omului. Însă, o problemă cu care se confruntă instituția constă în numărul abundent de cereri parvenite de la justițiabilii Înaltelor Părți Contractante. Potrivit celor mai recente date oficiale, un număr de 75 650 cereri sunt pendinte în fața Curții de la Strasbourg. Cu alte cuvinte, Curtea a devenit victima propriului său succes. Una din soluțiile acestei probleme constă în adoptarea unui mecanism consultativ prin intermediul căruia este consolidat dialogul judiciar între Curte și instanțele supreme europene. Mecanismul în discuție a fost instituit de Protocolul nr. 16 la Convenție, care urmează a fi ratificat de Republica Moldova. Aceasta ar constitui un instrument important pentru autoritățile judiciare naționale în consolidarea statului de drept și atingerea unui nivel mai înalt de protecție a drepturilor omului.Harmonising standards of human rights protection is one of the main aims of the European Court of Human Rights. However, one problem the institution faces is the large number of applications lodged by nationals of High Contracting Parties. According to the latest official figures, 75 650 applications are pending before the Strasbourg court. In other words, the Court has become the victim of its own success. One of the solutions to this problem is the adoption of a consultative mechanism through which judicial dialogue between the Court and the European supreme courts is strengthened. The mechanism in question was established by Protocol No. 16 to the Convention, which is to be ratified by the Republic of Moldova. It would be an important tool for national judicial authorities in strengthening the rule of law and achieving a higher level of human rights protection.
