PROTECȚIA MEDIULUI ÎNCONJURĂTOR ȘI SCHIMBĂRILE CLIMATICE. O ECUAȚIE PENTRU RECONCEPTUALIZAREA DREPTULUI LA UN MEDIU SĂNĂTOS ÎN DREPTUL INTERNAȚIONAL

Abstract

Orice persoană are dreptul la o viață curată și sănătoasă și un mediu sănătos și durabil. Pe măsură ce drepturile omului și mediu sunt interdependente, un mediu curat, sănătos și durabil este absolut necesar pentru exercitarea unei game largi de drepturi ale omului. Totodată, pe tot globul pământesc, drepturile omului sunt afectate în mod negativ și încălcate drept consecință a schimbărilor climatice. De mai bine de jumătate de secol Dreptul internațional public în permanență este îmbunătățit cu un cadru normativ care garantează dreptul la un mediu sănătos. Mai mult ca atât, deja este stabilit faptul că drepturile omului au o conexiune indisolubilă cu mediul în care trăiește fiecare ființă umană. Astfel, orice daună cauzată mediului de către fiecare persoană în parte intervine în exercitarea drepturilor omului.Everyone has the right to a clean, healthy life and sustainable environment. As human rights and the environment are interdependent, a clean, healthy, and sustainable environment is necessary for the enjoyment of a wide range of human rights. At the same time, all over the world, human rights are being negatively affected and violated because of climate change. For more than half a century, Public International Law has been continuously improved with a normative framework guaranteeing the right to a healthy environment. Moreover, it is already established that human rights are inextricably linked to the environment in which every human being lives. Thus, any damage caused to the environment by each individual person interferes with the exercise of human rights.
