LOCUL ȘI ROLUL PREȘEDINTELUI REPUBLICII MOLDOVA ȘI PREȘEDINTELUI ROMÂNIEI ÎN SISTEMUL AUTORITĂȚILOR PUBLICE. STUDIU COMPARATIV

Abstract

Instituția șefului de stat constituie obiect de cercetare atăt pentru știința dreptului constituțional, căt și pentru știința dreptului administrativ. Articolul este consacrat examinării, în plan comparativ, a rolului și locului șefului de stat în sistemul autorităților publice din Republica Moldova și România. Sunt analizate prevederile constituționale ce determină funcțiile și atribuțiile Președintelui Republicii Moldova și Președintelui României, opiniile expuse în doctrină, precum și jurisprudența constituțională în materie. Analiza comparativă ne permite să evidențiem care sunt trăsăturile comune, dar și diferențele dintre statutul juridic al Președintelui în aceste state. În opinia autorului, la nivelul Șefului de Stat sau ale Guvernului orice atribuție politică duce la un subsidiar administrativ și orice atribuție administrativă are un substrat politic, încât o delimitare între „politic” și „administrativ” apare ca fiind riscantă și didactic nerecomandabilă. În concluzie, autorul argumentează ideea necesității redefinirii rolului și locului Președintelui Republicii Moldova în sistemul autorităților publice, prin regândirea cadrului constituțional în vederea instaurării unui regim semiprezidențial după modelul României sau cel al Franței.The institution of the Head of State is a research object both for the science of constitutional law and for the science of administrative law. The Article is dedicated to the comparative examination of the role and place of the Head of State in the system of public authorities of the Republic of Moldova and Romania. The constitutional provisions determining the functions and duties of the President of the Republic of Moldova and the President of Romania, the views expressed in the doctrine, as well as the constitutional case-law in this area are analyzed. The comparative analysis allows us to highlight the common features, but also the differences in the legal status of the President in these States. In the opinion of the author, at the level of the Head of State or the Government, any political task leads to an administrative subsidiary and any administrative task has a political sublayer, that a distinction between "political" and "administrative" appears to be risky and uncommanding. In conclusion, the author argues the idea of the need to redefine the role and place of the President of the Republic of Moldova in the system of public authorities, by rethinking the constitutional framework with a view to establishing a semi-presidential regime along the lines of Romania or France.L'institution du chef de l'état est un objet de recherche à la fois pour la science du droit constitutionnel et pour la science du droit administratif. L'article est consacré à l'examen comparatif du rôle et de la place du chef de l'état dans le système des pouvoirs publics de la République de Moldova et de la Roumanie. Les dispositions constitutionnelles déterminant les fonctions et les devoirs du Président de la République de Moldova et du Président de la Roumanie, les opinions exprimées dans la doctrine, ainsi que la jurisprudence constitutionnelle en la matière sont analysées. L'analyse comparative nous permet de mettre en évidence quelles sont les caractéristiques communes, mais aussi les différences de statut juridique du président dans ces états. Selon l'auteur, au niveau du Chef de l'État ou du Gouvernement, toute attribution politique conduit à une filiale administrative et toute attribution administrative a un substrat politique, de sorte qu'une délimitation entre "politique" et "administratif" apparaît comme risquée et didactiquement déconseillée. En conclusion, l'auteur soutient l'idée de la nécessité de redéfinir le rôle et la place du Président de la République de Moldova dans le système des pouvoirs publics, en repensant le cadre constitutionnel afin d'établir un régime semi-présidentiel sur le modèle de la Roumanie ou de la France.Институт главы государства является объектом исследования как науки конституционного права, так и науки административного права. Статья посвящена сравнительному анализу роли и места главы государства в системе органов государственной власти Республики Молдова и Румынии. Анализируются конституционные положения, определяющие функции и полномочия Президента Республики Молдова и Президента Румынии, мнения, выраженные в доктрине, а также конституционная судебная практика по данному вопросу. Сравнительный анализ позволяет выделить как общие черты, так и различия правового статуса Президента в обоих государствах. По мнению автора, на уровне главы государства или правительства любая политическая атрибуция ведет к административному подчинению, а любая административная атрибуция имеет политический субстрат, так что разграничение между «политическим» и «административным» представляется рискованным и не рекомендуется. В заключение автор аргументирует необходимость пересмотра роли и места Президента Республики Молдова в системе органов государственной власти путем переосмысления конституционных основ с целью установления полупрезидентского режима по образцу Румынии или Франции.
