Abstract

The right to education is a right guaranteed by law. No one in the Republic of Moldova is restricted in his right to education. Only social differences determine that some people have access to an elitist education and others to an underground one. People sentenced to prison have a poor educational background that explains their failure in social adaptation. Detention does not abolish the right to education, on the contrary, it is an opportunity to achieve behavioral change, namely through the full exercise of this right. This is the reason why the executional – penal regulations present the right to education rather as an obligation of prisoners than as a right of them. This approach addresses the issue of exercising the right to education for convicts through the lens of legislation and the way to achieve it, in this sense, all 3 forms of education are taken into account - formal, non-formal and informal.
