Item Securing the ukrainian children’s refugees´ right to education: main barriers and challenges(CEP USM, 2024) Roșca, MarianaThe full-scale invasion of Ukraine forced many children to flee their country and look for a safe harbour abroad. Once a safe shelter was found, the Ukrainian families looked for ways to secure their children’s right to education. Although many efforts have been made to facilitate their access to this right, many barriers and challenges persist. On one side, the host countries’ barriers, along with the Ukrainian family’s decision to enrol in Ukrainian online learning platforms, jeopardise the children´s right to education and the quality of educational provision. Due to this, we argue that online education needs specific premises to be effective, and that is difficult to achieve in the conditions of Ukrainian refugee children and families, therefore, it should be combined with onsite education because the children’s inclusion in educational systems offers more benefits, protection and gives them the knowledge and skills to live a productive, fulfilling and independent life in the future. We propose a holistic approach that combines both online and onsite schooling, along with targeted support and interventions, that can be most effective in meeting the diverse needs of refugee children and ensuring their access to quality education.Item Respectarea drepturilor omului în raioanele de Est ale Republicii Moldova(2012) Cârnaț, Teodor; Cârnaț, MarinaArticolul reflectă unele experienţe ale organizaţiilor neguvernamentale din Republica Moldova, cum ar fi: Promo-Lex şi Comitetul Helsinki pentru Drepturile Omului din Republica Moldova. Evidenţiind un set de drepturi, mai des ignorate de autorităţile politice din raioanele de est ale Republicii Moldova, autorii menţionează că în acest stat „funcţionează de facto două sisteme juridice”: unul constituţional şi unul ilegal.Item DREPTUL PERSOANELOR PRIVATE DE LIBERTATE LA EDUCAȚIE. TEMEI JURIDIC. METODE DE REALIZARE. SEMNIFICAȚIE(CEP USM, 2023) Samoilenco, VictorThe right to education is a right guaranteed by law. No one in the Republic of Moldova is restricted in his right to education. Only social differences determine that some people have access to an elitist education and others to an underground one. People sentenced to prison have a poor educational background that explains their failure in social adaptation. Detention does not abolish the right to education, on the contrary, it is an opportunity to achieve behavioral change, namely through the full exercise of this right. This is the reason why the executional – penal regulations present the right to education rather as an obligation of prisoners than as a right of them. This approach addresses the issue of exercising the right to education for convicts through the lens of legislation and the way to achieve it, in this sense, all 3 forms of education are taken into account - formal, non-formal and informal.Item Finanțarea de către stat a învățământului general obligatoriu: interesul superior al copilului în lumina dreptului la educație și dreptului de a nu fi discriminate(CEP USM, 2023-09-30) Grosu, VladimirEducation is a special public service, which the State is obliged to support, first of all through adequate funding to ensure, among other objectives, an appropriate quality of education. However, realizing the importance of ensuring an appropriate level of quality of education, depending on financial possibilities, many States undertake the financing of compulsory general education both in public pre-university institutions and, at least partially, in private ones. However, this is not the case of the Republic of Moldova, where parents who opt for the education of their children in private preuniversity institutions, assume the entire cost of studies in these schools. Thus, the Moldovan State through its public policies suggests,contrary to what is stated in the legal texts, that the cost of studies in private schools of general education represents an exclusive burden of the parents.Item INTERPRETAREA EVOLUTIVĂ A DREPTULUI LA INSTRUIRE CA INSTRUMENT HERMENEUTIC UTILIZAT DE CĂTRE CURTEA EUROPEANĂ A DREPTURILOR OMULUI(CEP USM, 2021) Polisca, Cezara-ElenaThis paper aims to discern the importance of the evolutive method in assessing the cases regarding the right to education, which require to be interpreted so that the compromises provided in the European Convention on Human Rights can always be adapted to the reality of the group or society. Therefore, the main goal of the paper is to examine how the evolutive interpretation is used, as a hermeneutical tool, by the European Court of Human Rights in protecting individual educational situations against all the dangers and challenges that may arise.Item PROTEJAREA DREPTULUI LA EDUCAȚIE PRIN PRISMA LEGISLAȚIEI REPUBLICII MOLDOVA ȘI A JURISPRUDENȚEI CURȚII EUROPENE A DREPTURILOR OMULUI(Artpoligraf, 2020) Cîrnaţ, Teodor; Polisca, Cezara-ElenaThe right to education is one of the fundamental human rights, enjoying today a universal recognition, both in international and regional conventions, as well as in the constitutions of modern states. The proof to this serves the fact that the most widespread provision is the right to education, which is contained in the constitutions of 43 Council of Europe Member States [1, §85]. The fundamental nature of this right stems also from its inherent connection to human dignity [2, p.127]. Despite the fact it does not have a long history as a fundamental material right in the Republic of Moldova, the concern for education, as we can easily see, was incorporated at constitutional level in 1994, by adopting the Moldovan Constitution. We tend to believe that the Protocol no. 1 to the European Convention on Human Rights has served as an impetus to this.Item INFLUIENȚA STĂRII DE URGENȚĂ ASUPRA DREPTULUI LA ÎNVĂȚĂTURA(CEP USM, 2020) Chibac, Natalia; Pozneacova, VeronicaArticolul reprezintă un studiu dedicat naturii dreptului la învățătură, importanței acestui drept și poziționării lui în cadrul drepturilor naturale și inalienabile ale omulu prin prisma reglementărilor naționale și internaționale. Scopul urmărit de autori rezidă în determinarea impactului declarării stării de urgență asupra dreptului la învățătură și în depistarea eventualelor încălcări aleacestui drept.Item ACCESUL LA EDUCAȚIE AL DEȚINUȚILOR CONFORM STANDARDELOR CEDO(Institutul Naţional al Justiţiei, 2020) Scobioală, Diana; Polisca, Cezara-ElenaDreptul la instruire este unul din drepturile fundamentale ale omului, a cărui importanţă a fost conturată într-o lume aflată în permanentă schimbare. Acesta constituie posibilitatea de dobândire a altor drepturi, de vreme ce doar persoanele care au fost supuse educaţiei pot beneficia de instrumentele juridice și economice necesare pentru a lupta cu sărăcia, cu discriminarea socială și economică, cu alte încălcări ale drepturilor omului. Importanţa dreptului la instruire se conturează perfect și în domeniul sistemului penitenciar, care trebuie să evite transformarea condamnatului într-un potenţial recidivist și să contribuie la resocializarea acestuia. Cu toate acestea, în realitate accesul la educaţie al persoanelor private de libertate nu este garantat în plenitudinea sa. Acest studiu abordează anumite standarde privind accesul la educaţie al persoanelor condamnate la pedepse privative de libertate, stabilite în sistemul Convenţiei Europene a Drepturilor Omului din optica naturii fundamentale a dreptului garantat de art. 2 din Protocolul nr. 1.Item ACCESUL LA EDUCAȚIE PREȘCOLARĂ ȘI LA ÎNVĂȚĂMÂNT SECUNDAR ȘI POSTSECUNDAR. REALITATEA REPUBLICII MOLDOVA VERSUS STANDARDE CEDO(CEP USM, 2020) Mocanu, Victor; Polisca, Cezara-ElenaEducația reprezintă un factor crucial pentru evoluția umană, care conferă toate instrumentele necesare pentru dezvoltarea persoanei în cadrul mediului cultural în care locuiește. Aceasta ia forma unui proces permanent de pregătire personală, profesională, socială și culturală, care are ca scop accesul la cunoștințe, știință, tehnică și la alte bunuri și valori culturale, iar realizarea efectivă a acesteia înnobilează persoana. Scopul acestei cercetări constă în analiza condițiilor de acces la educație preșcolară și la învățământ secundar și postsecundar, prevăzute în legislație, precum și a standardelor stabilite prin sistemul Convenției Europene a Drepturilor Omului pe palierul asigurării acestui drept.
