    Constituţionalismul în Uniunea Europeană: provocări şi perspective [Articol]

    In the last period, we have witnessed in the European Union some trends that we can identify as worrying, of erosion of the concept of con- stitutionalism which represents, in a broad sense, a set of norms and principles that advance the idea that authority, as an act of governance, derives from their observance. This crisis reveals that agreements between the governments of the member states, and the supranational political and legal institutions of the European Union are insufficient to maintain unity and make decisions con- cerning priorities. In other words, the political and legal sustainability of the European Union requires a certain methodological support that could contri- bute essentially to the construction, interpretation, and coherent evaluation of the theoretical and practical problems of the political and legal reality of the European Union which is more than an international organization or a con- federation of states, without having become a federal entity. The legitimacy of constitutionalism as a theory of political action increases the gap between the important political decision-makers in the European Union and the legi- timate, objective interests of the member states. This paper aims to analyse three main themes: the challenges to constitutionalism that the states of the European Union have been facing in recent times; opportunities and strate- gies to combat the erosion of democratic constitutionalism; and the future of constitutionalism in the European Union. The research results reveal that the apparent inability of the European institutions to strengthen the rule of law and the democratic legitimacy of the Union can only be overcome through an innovative perspective of reforming the EU treaties and a firm political com- mitment to promote solidarity and mutual respect between the Member States.

    Locul și rolul cratologiei juridice în cadrul procesului de studiu juridico – universitar

    În condiţiile noilor opţiuni politice în spaţiul est-european un interes major prezintă problema conceptului puterii de stat, care trebuie pusă în serviciul procesului democratic ce se doreşte a fi ireversibil şi pentru realizarea acestui deziderat sunt necesare eforturi permanente în vederea clarificării esenţei puterii, a puterii politice, puterii de stat, a factorilor ce influenţează evoluţia acesteia. Analizând natura juridică a puterii de stat și menționând faptul că puterea de stat este un fenomen destul de complex, ale cărui ramuri, manifestări, trăsături au fost analizate de numeroși autori din trecut până în prezent, considerăm oportună sistematizarea acestor cunoștințe într-un domeniu aparte de cratologie (știința puterii) – Cratologie juridică, a cărei includere în planul de studii universitare al Facultății de Drept pentru masteranzi la specialitatea Drept public este deosebit de utilă.

    Legitimitatea – condiţie obligatorie a menţinerii puterii de stat

    Din cele expuse, putem să concluzionăm că puterea de stat nu poate fi menţinută decât în măsura în care structurile de putere sunt legitime, iar deciziile politice, inclusiv legile exprimă voinţa generală şi nu sunt folosite împotriva unei părţi a populaţiei. Iar legitimitatea unei puteri statale poate fi privită dintr-o dublă perspectivă: ca act al desemnării structurilor de putere (cucerirea sau actul de întemeiere a puterii); concordanţa dintre conţinutul deciziilor politice şi aşteptările celor guvernaţi.

    STATUL DE DREPT: ÎNTRE LEGISPRUDENȚĂ ȘI JURISPRUDENȚĂ

    The term „legisprudenţă” came recently in legal vocabulary, and refers to the legislative work. Social reality is pressuring the legislature to arrive at appropriate ways of regulating social relations. Jurisprudence its results contribute to the formation and consolidation of a legal system that meet society’s expectations and participate in training, a state of law. To that end between the compilers and applying the right must be a permanent connection (directly and/or through science), which in this article is illustrated by the examples of constitutional and european jurisprudence.Legisprudenta is rational theory of legislation, which is to develop the idea of freedom as a principle. giving the legislator the possibility to exceed the jurisprudence, to create something new. However, a rule is coming as an innovation, but this is not always properly understood and applied, leaving room for interpretation, which complicates the legal qualification. Thus, the outcome of the application and its legal qualification. preceded by actions of the interprets the rule, and the assessment capacity and anticipate of the possible evolutions of social relations as reflected in normative-legal text, approved by the legislature.
