Ultimately, it contributes to a culture of transparency, accountability, and respect, fostering a workplace where everyone can thrive.Item Excluderea obligativităţii titularului raportului de muncă de a audia cursul de instruire în domeniul securităţii şi sănătăţii în muncă şi consecinţele acesteia la cercetarea accidentelor în câmpul muncii în Republica Moldova(CEP USM, 2024-09-20) Postica, RuslanThe manager of an enterprise, institution or organization with the status of a legal person, regardless of the type of ownership, legal form of organization and departmental subordination or branch affiliation, referred to as the employer/employment relationship holder, who employs workers on the basis of employment contracts, has several obligations towards the unit they manage. These obligations are laid down in the statutes of the enterprise, in the employment contract concluded between the unit and the manager/administrator/director, and in the legal acts. As the unit's internal rules are optional, the parties negotiate their content within the limits of the legislation, while the legal rules are mandatory and binding for the conduct of the activity. One of the essential obligations of the head of the establishment, in accordance with the legal provisions, is the obligation to ensure the occupational health and safety of workers in all aspects of the activity carried out. In this regard, the legislator approved the Law on Occupational Safety and Health No. 186/2008, which sets a number of obligations for the employer, aimed at ensuring the best working conditions for the protection of life, health and physical and mental integrity of workers, including, until 22.04.2024, the obligation to attend training courses in the field of occupational health and safety.Item Aspectele practice referitoare la soluţionarea litigiilor de muncă de către instanţa de judecată(CEP USM, 2024-11-07) Macovei, Tatiana; Macovei, GheorgheLabor disputes that have not been settled amicably by the employer and the employee can be settled by the court if the employee applies for a summons. in this communication we propose to address the most important aspects that refer to the resolution of individual labor disputes by the court. In this article the authors elucidated the characteristic features and the specific effects of the suspension of the individual employment agreement. Combinatul Poligrafic, 2020-05-22) Romandaș, Nicolae; Boișteanu, EduardThe content of this scientific communication is dedicated to the institution of elected representatives of employees which is recognized as an alternative to trade unions (according to the law, in organizations without trade unions, the interests of employees can be defended by their elected representatives. Therefore, the coexistence of these two legal institutions is excluded). In this regard, national and EU legislation was analyzed, highlighting the positives and negatives. Interpreting the legal provisions, we analyzed the notion of „elected representatives of employees” who are appointed those employees elected at the general meeting (conference) of employees in units within which no trade unions are formed to promote and defend the interests of employees. Reference was made to their attributions, mentioning that the collective rights (the right to administer the unit, to conduct collective bargaining, etc.) can be exercised by the elected representatives of the employees. Din aceste considerente atât pentru beneficiul organizaţiei, care reprezintă interesele cetăţenilor, cât şi pentru propriul beneficiu al colaboratorilor, conducerea acesteia trebuie să lucreze permanent, şi în orice mod posibil, la sporirea potenţialului personalului său.
