Item CIVIL COURT DECISIONS IN THE REPUBLIC OF MOLDOVA: ESSENCE, DISTINCTIVE FEATURES AND SEPARATE TYPES(2022) Arseni, Igor; Sosna, AlexandruIn this article, the authors conduct a scientific study of the distinctive features and highlight certain types of judgment in civil cases. In particular, the authors draw a distinction between other decisions issued in the framework of civil proceedings, and also highlight certain types of court decisions inherent exclusively in civil proceedings. The authors give specific features of the court decision that distinguish it from other acts of the court, namely, the court decision is a procedural document that resolves the case and restores violated rights, issued by the court in the procedural form established by law on the basis of consideration of the case on the merits. Separately, a characteristic is given to each type of court order and the requirements that each court order must comply with are characterized.Item DESPRE INSTITUŢIA PROBAŢIUNII ÎN DREPTUL CONTRAVENŢIONAL(Editura ULIM, 2018-10-16) Pantea, OlegÎn această publicaţie au fost analizate aspectele teoretico-practice privind constatarea faptelor contravenţionale de organele de probaţiune şi intervenţia socio-pedagogică a acestei instituţii în procesul de executare a unor pedepse contravenţionale. Lucrarea este caracterizată printr-o combinaţie din stabilirea faptelor şi supravegherea/ asistenţa contravientului. Un compartiment aparte a fost dedicat caracteristicii juridice a contravenţiilor constatate de probaţiune prin prisma elementelor constitutive contravenţionale. Elaborarea acestui material s-a dorit a fi de utilitate atât pentru viitorii jurişti, cât şi pentru alte persoane interesate.Item DIFERENŢE CONCEPTUALE PRIVIND TRANZACŢIA JUDICIARĂ ŞI TRANZACŢIA EXTRAJUDICIARĂ(CEP USM, 2021) Gaja, AlinaThe purpose of this article is to highlight the institutional differences between the court settlement and the out-of-court settlement. In the Republic of Moldova, the transaction is a contract governed by the provisions of the Civil Code, used as a tool to prevent or end a legal dispute, or to resolve difficulties arising during the execution of a court decision. At the same time, the Civil Procedure Code operates with the notion of transaction used in order to terminate a civil lawsuit. Through this research, we will notice what are the differences between the two institutions, and how they can be interconnected.
