(1), lit. a) din statutul CPI(2024) Vasiliu, LiubaThe aim of this scientific article is to create a reasoned concept of crimes against humanity that would correlate with the realities and needs of international and national criminal law. In order to achieve this aim, we have carried out a thorough analysis of the existing doctrinal concepts of crimes against humanity; multilateral research of normative acts of international character, examination of cases from international judicial practice, as well as the study of the latest changes in criminal law with reference to crimes against humanity. In this context, it is essential to evaluate the necessity and proporti- onality of the legislation adopted in the period of public health emergency, as well as iden- tify efficient guarantees in the case where governments put in place exceptions, derogati- ons, or restrictions on human rights. More specifically, these limitations on human rights need to be examined according to the tests of legality, legitimacy, and proportionality.Item CETĂŢENIA ÎN DREPTUL CONSTITUŢIONAL AL REPUBLICII MOLDOVA(CEP USM, 2021) Deleanu, RuslanThe citizenship of the Republic of Moldova expresses the affiliation of a person to the Moldovan state and it is not only a simple relationship of „affiliation”. Citizenship gives the person an identity and is a legal situation resulting from the stable legal relations between the natural person and the state, the situation characterized by the fullness of mutual rights and obligations provided by the Constitution and other laws. Citizenship is exclusively a matter of state. The text of the Convention cannot be interpreted separately from its jurisprudence, which evolves continuously and is appreciated for its value, its pontential to consolidate protection and to exclude abusive practices regarding the fundamental human rights and liberties guaranteed by the Convention.
