    VIOLENȚA ÎN FAMILIE COMISĂ ÎN CYBERSPAȚIU

    This article starts from the premise that most crimes can be committed not only offline but also online. Thus, domestic violence can also be committed in cyberspace. Moreover, the concept of “cyberviolence” was outlined. This concept is found in several documents adopted under the auspices of the United Nations, the Council of Europe, and the European Union. More recently, the European Court of Human Rights has expressly emphasized that cyberviolence constitutes a form of domestic violence. It is about the cases of Buturugă v. România and Volodina v. Russia (no. 2). This article analyses the reasoning of the European Court of Human Rights. It is shown that cyberviolence against a family member generates a serious interference in the private life of the person, i.e., in the right guaranteed by art. 8 of the European Convention on Human Rights and, respectively, of art. 28 of the Constitution of the Republic of Moldova. And the national authorities have a positive obligation to conduct an effective investigation. Such an investigation must lead to the identification of the perpetrator, his punishment and compensation to the victim.

    Violence in schools has become a significant concern worldwide. Therefore, it is not surprising that in recent decades, several states have developed legislative acts aimed at policies to combat this phenomenon and the nature of the social response to school violence. From these considerations, in the present study, we propose to examine specific provisions regarding the prevention of violence in schools, as well as to identify, from the legislation of Sweden, Italy, and the United Kingdom, best practices in combating violence in the educational environment

    CYBERBULLYING: PROVOCARE SAU REALITATE?

    Cyberbullying or cyberharassment is a form of bullying or harassment using electronic means. Cyberbullying and cyberharassment are also known as online bullying. It has become increasingly common, especially among teenagers, as the digital sphere has expanded, and technology has advanced. The lack of specific regulations in the national criminal and contravention legislation makes it difficult to qualify cyberbullying and makes it almost impossible to hold people accountable for such acts. Following the analysis, some proposals of lege ferenda will be outlined, in order to adapt the national criminal / contravention legislation to the current conditions.

    Online harassment or so-called cyberbullying takes place through social networks, various online applications, chat rooms, where posts can be made public via computers, tablets or mobile phones, when a person or group of people is repeatedly degraded, criticized and ridiculed by another person or group of people, Internet users. Currently, online harassment is common because of the great advantage of anonymity. Moreover, cyber bullying is preferred because there is a wide range of witnesses who could pass on the humiliations to which the harassed person is subjected.
