The digitalization of justice, including civil proceedings, entails not only the modification of civil procedural legislation but also the implementation of viable mechanisms that align with the technological level of societal development. By digitalization of justice, we understand the process of adopting and integrating digital technologies within the judicial system and the administration of justice. Undoubtedly, the integration of digital technologies also pertains to the execution procedure, which is the most complex and crucial stage in a civil process, upon the effectiveness of which largely depends the achievement of the ultimate goal of the civil process. The tracking of digital assets involves the process of identifying, monitoring, and authenticating rights and ownership of digital objects and elements in the virtual or online environment, for the purpose of executing tasks and achieving the objectives of the execution procedure. Achieving these goals requires amendments to both civil and civil procedural legislation, considerations which will be examined in the present study.Item Opinia copilului în contextul procedurii de înapoiere sau exercitare a dreptului de vizitare a acestuia(CEP USM, 2024) Vrabie, DinaÎn cadrul procedurii de înapoiere sau exercitare a dreptului de vizitare, opinia copilului urmează a fi luată în considerare, precum se procedează și în multe alte chestiuni ce privesc drepturile și interesele acestuia. Prevederile internaționale permit instanțelor administrative și judiciare să nu dispună înapoierea copilului, în cazurile în care acesta se împotrivește. Iar dat fiind faptul că, procedura de înapoiere sau exercitarea dreptului de vizitare a fost înființată cu scopul protecției intereselor exclusiv ale copilului, de opinia acestuia urmează să se țină cont obligatoriu, în cazul în care se constată că vârsta și gradul de maturitate îi permit să perceapă și să se expună asupra situației în care se află.Item Asigurarea respectării interesului superior al copilului în procedura de mediere(CEP USM, 2023) Chifa, FeliciaMediation is an alternative method of settling disputes amicably in a structured, flexible and confidential process with the assistance of one or more mediators. The mediator is a third party specialised in dispute resolution who facilitates negotiations between the parties. The legislation regarding mediation regulates the way the mediation process is carried out, so that the best interest of the child is ensured. Mediation has numerous legal, economic, social and psychological advantages, compared to other ways of resolving disputes. The central authority may be the authority of the requesting State as well as the authority of the requested State. In any situation, the central authority of the state must cooperate efficiently and in timely manner to ensure the immediate return of children moved or detained illegally and to allow the realization of the right of visit. At the same time, it is for the central authority to take the preliminary steps for the out-of-court and amicable settlement of the family dispute.Item COMPROMITE SUBCULTURA CRIMINALĂ EDUCAȚIA ȘI DEZVOLTAREA ARMONIOASĂ A MINORILOR?(CEP USM, 2022-09-30) Samoilenco, VictorFrom all of the social anomies existing in the Republic of Moldova, the criminal subculture represents the most serious social danger. Children and young people in particular have a high risk of subculturalization, fact that is due to their age characteristics. The poor level of development of critical thinking, in the case of children, it is decisive when they adopt antisocial solutions. To decrease the level of adherence to that subculture, the state must adopt preventive measures and combative measures in equal measure. The incrimination of some antisocial acts such as the indoctrination of children can also represent a suitable option. Unfortunately, most prophylactic measures are taken in the detention environment, the extra-prison environment being ignored. It is disregarded that outside the bars, this criminal scourge is also very well developed.
