Caracterul contencios al cauzelor privind răpirea internaţională de copii [Articol]

Abstract

Prezentul articol constituie o cercetare ştiinţifică prin conţinutul căreia se examinează caracterul contencios al cauzelor privind răpirea internaţională de copii. Prezenţa litigiilor este iminentă în cauzele privind înapoierea sau exercitarea dreptului de vizitare a copilului din cauza intereselor contrare ale persoanelor în a cărui grijă se află copilul. În acest demers este evidenţiată necesitarea asigurării unui echilibru între interesele superioare ale copilului şi drepturile părinţilor săi. În baza prezentei cercetări au fost formulate concluzii şi recomandări ce pot fi utile pentru eventualele modificări legislative. This article constitutes a scientific research which examines the content of which the contentious nature of cases concerning international child abduction is examined.
