Item ASIGURAREA RESPECTĂRII DREPTURILOR DE MUNCĂ A DIFERITOR CATEGORII DE SALARIAȚI PRIN INTERMEDIUL REGLEMENTĂRII UNITARE ȘI DIFERENȚIATE A MUNCII(CEP USM, 2024-11-07) Josanu, DorinThe diversity of legal employment relationships in the society requires a complex approach towards their regulation. Both at the national and international level, including through the community norms, we observe the attempt to establish norms of conduct for each employment relationship, by combining provisions of common nature, applicable to all, with special provisions that account for peculiarities of work performed, depending on various factors – both objective and subjective. The goal of this work is to identify the international norms, including European, called to regulate the particularities of different jobs, but also their eventual integration into the internal legal system. Through using the method of analysis of the normative framework, including the ILO Conventions and the EU Directives, the author concludes that at the national and community level, the regulation of labour relationships of different categories of employees is made by combining some general norms, which establish rules of conduct for all employers and employees, with special rules that either supplement the framework established by the general rules, or provide for exceptions to their application for certain particular relationships.Item APĂRAREA DREPTURILOR ȘI INTERESELOR CADRELOR DIDACTICE PRIN INTERMEDIUL INSTITUȚIEI PARTENERIATULUI SOCIAL(CEP USM, 2024) Josanu, DorinThis article analyses the possibility of defending the rights and interests of teachers by means of their representatives – trade unions, within the social partnership. The article describes the forms of defence of the rights and interests of teachers and the place of civic defence. As an example of the rights and benefits granted to teachers through this means, the author of the article analyses the acting collective bargaining agreement, along with the conditions under which the teachers may benefit from these benefits. The method used in the research includes the analysis of the acting normative framework, including the domain related acts of social partnership and the synthesis of existing rights and guarantees, resulting from collective bargaining.Item FORME DE APĂRARE A DREPTURILOR ȘI INTERESELOR CADRELOR DIDACTICE(CEP USM, 2023) Josanu, DorinÎn prezentul articol sunt analizate formele de apărare a drepturilor și intereselor salariaților, cu aplicare cadrelor didactice și posibilele mijloace de realizare în cadrul diferitor forme. Concomitent, se încearcă o determinare a rolului care îl joacă pentru cadrele didactice, și locul pe care îl ocupă formele alternative de apărare a drepturilor și intereselor – obștească, jurisdicțională nejudiciară ș.a., – în coraport cu formele de bază de apărare a drepturilor și intereselor – cea judiciară și cea administrativă. Drept exemplificare a drepturilor și înlesnirilor obținute de către cadrele didactice pe această cale este analizată convenția colectivă la nivel de ramură, în vigoare în prezent, dar și condițiile în care cadrul didactic va putea beneficia de aceste înlesniri. Metoda utilizată în cadrul cercetării include analiza cadrului normativ în vigoare, inclusiv a actelor parteneriatului social din domeniu și sinteza drepturilor și garanțiilor existente, rezultate în urma negocierilor colective.
