    ROLUL CONSILIULUI DE INTEGRITATE ÎN PREVENIREA ȘI COMBATEREA CORUPȚIEI: VIZIUNE CRITICĂ

    In 2016, the Parliament of the Republic of Moldova adopted Law no.132 regarding the National Integrity Authority, which established a new control mechanism for compliance with integrity regimes. In order to ensure a control and balance mechanism for ANI’s actitity, the Integrity Council was created. It was initially intended to supervise the activity and processes within the National Integrity Authority. In the article we will analyze the activity of the Integrity Council based on the normative acts and own experience. In the end, we will come to the conclusion that the National Integrity Authority can carry out its duities without the monitoring of the Integrity Council

    VIOLENȚA ÎN MEDIUL ȘCOLAR ÎN JURISPRUDENȚA NAȚIONALĂ

    The research on the particularities of violence in the school environment in the national jurisprudence represents the results of some investigations obtained as a result of the specialized doctrine, the analysis of the national legislation, the analysis of the files from the judicial practice of the Republic of Moldova relevant to the purpose of the study in terms of the legal framework and the qualification of the facts. From a practical point of wiew, court sentences on criminal cases resolved in national courts on criminal cases resolved in national courts were studied: 11 practical cases that were examined and are still being examined under the aspect of criminal law in the period 2016-2023.

    ZOOSADISMUL: ANALIZA FENOMENULUI

    Prezentul studiu reprezintă o încercare de analiză a fenomenului numit „zoosadism” ce constituie o latură neagră a dragostei, una dintre cele mai dure forme ale ei. Pe această cale, vom dezvălui sensul noțiunii de ”zoosadism” sub aspect comun și medical. Întru crearea unei imagini complexe a fenomenului, au fost stabilite și supuse analizei cauzele acestuia, identificate trăsăturile lui definitorii cu determinarea particularităților actelor de zoosadism realizate de către minori. Au fost examinate metodele sadice de tratament crud al animalelor, caracterizate sub aspect obiectiv și subiectiv. Este analizat zoosadismul din perspectivă sexuală și non-sexuală, marcându-se manifestarea acestuia pe rețelele de socializare și degenerarea fenomenului în comportament agresiv îndreptat contra ființei umane. Studiul conține și formularea unor recomandări în vederea prevenirii și combaterii zoosadismului.

    RENUNȚAREA DE BUNĂ VOIE DE LA SĂVÂRȘIREA INFRACȚIUNII A COAUTORULUI

    The article is dedicated to some aspects related to the voluntary abandonement of the commitment of the criminal offence in the case of the commission in participation, being, in particular, a co-author. Concerning the co-author, we observed that special legal norms are not contained in the Criminal Code of the Republic of Moldova, probably for the reason that in the case of voluntary abandonement of the criminal offence, the legislator considers that the same of rules qualification whichare applied to the co-author. For the elaboration of the article, the existing doctrinal material, the national legislation and some normative sources of other states, relevant to the exposed subject, have been analyzed. The methods used are the analysis and synthesis of scientific and normative sources. As a result of the research, we can conclude that regarding the abandonement of the co-author from committing the crime, art.56 Criminal Code of the Republic of Moldova must be amended.

    AUTORUL MEDIAT: REFERINȚE DE DREPT COMPARAT

    According to the criminal law of the Republic of Moldova, the author is also the persons who committed the crime through perssons who are not liable to criminal liability due to age, irresponsibility or other causes provided by the Criminal Code. The mediated author is also provided for in the criminal legislation of other states.

    DETECTAREA ȘTIINȚIFICĂ A CONDUITEI SIMULATE: UTILIIZAREA TEHNICII POLIGRAF

    Simulated behaviour of human beings was always one of the areas of interest for criminal law studies. Detection of this type of behaviour continues to be one of the focus of nowadays scientists. Lie detector (polygraph) has been created as a tool for finding the truth in order to establish the guiltiness or the innocence of the person in a criminal trial. In Moldova, the Law no. 269 on application of polygraph testing was adopted in 2008.

    INDIVIDUALIZAREA JUDICIARĂ PRIN APLICAREA PEDEPSELOR COMPLEMENTARE

    Regarding the order of application of the complementary punishments, according to our criminal provisions on which we intend to make a generalization, we mention that the complementary punishments are those punishments that come to complete the main punishment. They cannot be applied independently, so they will always accompany a main punishment. Complementary punishments are regulated punishments in order to supplement the effects of the main punishments. Given the fact that the complementary punishments are applied by the courts only in addition to the main punishments, then the latter come to fulfill, together with the main punishments, the functions of the punishment stipulated in paragraph 2 art.61 CP of the Republic of Moldova.
