    The impact of COVID-19 on the relationship between governance and society: evidence from an online survey

    In order to understand the impact of the COVID-19 pandemic on the relationship between governance and society, we surveyed approximately 500 Moldovans using an online instrument designed to recover the causal impact of the pandemic on the relationship between Moldovan citizens, the current governance and expected outcomes. Results show large negative effects across many dimensions. The article highlights how the relationship between government and citizens developed during the pandemic and underlines some vulnerabilities of Moldovan society which were also present before COVID-19, but intensified during the crisis. Due to COVID-19, 41,5% of Moldovans have changed their lifestyle and 88,4% argue that their situation is worst due to the fact that the pandemic crisis deepened the previous social, political and economic crises of the country. Finally, 35.4% of respondents point out to quite high levels of inefficient communication as well as contradictory information of governmental institutions and 75,5% consider there is a persisting lack of transparency in governmental communication during the pandemic crisis. Thus, we show that the economic and health-related shocks induced by COVID-19 expanded systematically on the society as a whole, with large negative effects on the relationship between governance and society.

    Modernizarea și paradoxul dreptului și al drepturilor

    The research behind this paper has been directed towards identifying the governance mechanisms focused on the protection of the human rights, being accompanied by studies that have defined states and processes occurring in societies that are increasingly interconnected. Several stages are shown when referring to these studies: identification of the demands made by citizens towards institutions and authorities; definition of the government’s perspective on the issues of the citizens and the society; determination of solutions so that in the Republic of Moldova the transition to a modernized society occurs, in which rights and freedoms are protected. As a result, there have been identified several problems not only of conjunctural nature (such as the pandemic crisis and the war in the region, presented in the paper as a case study), which constitute impediments to the development of the Republic of Moldova, but also deeper problems rooted in society, such as lack of trust, lack of will, lack of integrity, lack of efficiency of legal institutions etc. All these have generated a paradoxical state of law and legal institutions. Thus, the article examines the combined analysis of the modernization-crisis-law concepts through theoretical and methodological incursions that make the individual-collective connection, highlighting the way modernization is seen in the Republic of Moldova and indicating the need to review the role of law in the society.

    De ce tranziția la standarde de ordine și securitate publică sunt pe agenda instituțiilor de invățământ?

    Given that we assign to higher education an important role in training the skills of future professionals, then standardisation may be explored as a tool for sharing theoretical knowledge, designed and accessible to support the development of practice. Change, transition, and reform are dependent on the human factor, that is willing to transfer the knowledge, and the existing good practices into realities translated into state policies, action plans and development strategies. The objective of this article is to highlight the benefits that can be brought about by an educational process in accordance with the standards of efficiency, performance and quality, as well as detailing some key aspects that make legal education a facilitating factor in the transition to standards of order and security acknowledged and promoted at European level. The contextualisation of three major topics: transition, standards and education is carried out in the context of a strong preference for the modernisation of the Republic of Moldova, in the hope of a significant impact through time, in particular for ensuring security, order and protection of citizens.

    Criza pandemică, un imbold pentru modernizarea societății moldovenești

    The social order and stability, security and well-being have become essential in the context of the pandemic crisis, highlighting many social and human issues. This article, focusing on the identification of governance mechanisms for the protection of human rights, emphasizes the weaknesses shaped by the pandemic crisis and argues in favor of the need to modernize the Moldovan society. With the assessment of the social-human impact of the pandemic as main objective, the theoretical-methodological framework of synergetics has been used, enabling to deal with the problem within the conceptual, functional, and operational frameworks.

    Rationality and responsibility: Benchmarks to re-evaluate the law in the context of the pandemic crisis

    Human and social vulnerability in the face of the pandemic once again raises the question of knowledge and of the two key dimensions of the individual (rationality and responsibility) framed in the various relationships they establish (with nature, with other individuals, with state institutions etc.). These become relationships of knowledge and awareness concerning the facts and laws of social-state organization. Being aware that the pandemic crisis left its mark on all areas of life, changing the nature of human relations, affecting the benchmarks of values, and requiring a review of the foundations of social organization, we believe it necessary to assess the current situation through a systemic approach aimed at identifying the benchmarks of the balance between individuality and sociality. Thanks to the assessment of the interdependencies between the individual and the social, the following objectives were addressed: to define the changes caused by the pandemic and analyze the social processes; to validate the decisions taken by the authorities from a logical, praxeological and axiological point of view; to emphasize the importance of norms and principles in the social organization; to determine the role of social actors in overcoming the crisis, and to assess how social relations have evolved under pandemic conditions. Therefore, the present article, applying an interdisciplinary methodology to the pandemic crisis, aims to evaluate, understand and raise awareness of the situation and its impact on the social and human situation, where solidarity, rationality, and human responsibility are being reassessed.

    Interdisciplinary contextualization of legal education and research

    The article aims to assess the possibility to revise the current theoretical-methodological framework of legal science, in order to update the law foundations by adopting an interdisciplinary research framework. Drawing on the multitude of differences between fields and disciplines, and although some closeness could be found between the object of the study or the identity of the object of study of human sciences, we argue that there is a need to overcome the current format of legal knowledge (understood both as a process of legal education and research). We conclude that the way in which we consider useful this transition from the current segmented and specialized formula of legal education and research to the formula of an integrated approach should be implemented through the interdisciplinary legal knowledge in the framework of a reformed general theory of law.

    Theoretical and methodological foundations of the analysis of governance focused on human rights

    This article deals with the essential dimensions in which theoretical approaches are carried out, as well as the methodological ones of government research in relation to the processes of modernization and democratization of societies, with priority given to the protection of human rights. Considered an essential dimension of contemporaneity, democratization cannot be treated outside government. That is why the basic sources used outline the common areas of analysis and circumscription of social and state realities in the direction of facilitating the transition process to the standards of good governance. Thus, through the scientific discourse of the government focused on the protection of human rights, the aim is to identify long-term solutions in order to establish in the conditions of the Republic of Moldova good practices in the person-state-law relationship.

    Sistematizări asupra profilului științei juridice în condiții de criză

    Human societies have periodically gone through various crises. Similar to the impact on societies, human activities have been marked by the processes, problems, and crises they go through. In this line of thought, the law is no exception. Back in the 1940s, Mircea Manolescu argued that each generation witnesses crises. Nowadays, the law crisis is framed in relation to either the doctrinal framework or to the established and contradictory legal practices, etc. At the same time, legal science is the one considered to be guilty of all the evils in the world, incapable of being a true science, to offer safe and effective solutions to the problems facing the society, the state, and the person. Moreover, the crisis caused by the pandemic has outlined the need for a review of the legal science´s provision, in terms of raising awareness as well as a social, legal, and civic responsibility.
