Item UNELE ASPECTE PRIVIND CONTRACTUL ELECTRONIC(CEP USM, 2024) Chibac, NataliaWith the development of scientific and industrial progress, digital tools have become the aid of citizens and extend electronic commerce. Currently, electronic commerce is constantly expanding, and contracts concluded by electronic means are increasingly used by citizens due to the economic and temporal advantages compared to the classical way of contracting. In this article, some aspects of the electoral contract are analyzed to provide clarity in the current transactions and an analysis is made of the role of the intermediary, as a provider of information from the seller to the consumer (buyer). In the current normative acts, the role of the intermediary is estimated, and as a “bridge” between the seller and the consumer, it is necessary to establish certain requirements for the intermediary and ascertain “what” and “how” he will answer in the process of protecting the consumer in electronic transactions.Item DELIMITAREA CONTRACTULUI DE SERVICII TURISTICE DE ALTE CONTRACTE(2014) Chibac, NataliaContractul de servicii turistice este unul cu caracter complex şi are unele elemente care se aseamănă cu alte contracte civile: de vînzare ‒ cumpărare, locaţiune, transport, antrepriză, contractul de muncă. Elementele cele mai mportante care delimitează contractul de servicii turistice de alte contracte civile sînt destinaţia şi scopul acestui contract de a deservi persoanele fizice autohtone şi străine, de diferite vîrste, pe parcursul vacanţei, concediului, tratamentului sau, în general, al timpului lor liber, cu un spectru de servicii foarte numeros şi diversificat, care sînt prestate pentru asigurarea odihnei, tratamentului etc. la cel mai înalt nivel.Item DREPTURILE ȘI OBLIGAȚIILE PĂRȚILOR ÎN CONTRACTUAL DE SERVICII TURISTICE PRIN PRISMA LEGII DE MODERNIZARE A CODULUI CIVIL AL REPUBLICII MOLDOVA NR.133 DIN 15.11.2018(Tipografia Artpoligraf, 2019) Chibac, NataliaThe contract for tourist services is a legal instrument of the achievement of business complex and represents the agreement between an organizer, which undertakes to purchase the traveler, in exchange for a price, a stay or a trip, ensuring its comfort and leisure. One of the main peculiarities of the legislation tourism is the right of the tourist to demand from the organizer providingallservices, whattheyincludeinthepackage. The rights andobligations ofthe parties are specific; this factis determined by the nature of the contract, as well as the quality of the consumer of the tourist. Therefore, the Civil Code of the Republic of Moldova includes a mandatory rule in the article.(2), art.1145, which prohibits the derogation of the legal provisions to the detriment of the tourist. Any contractual clause that worsens thesituationofthetourist will bestruckbyabsolutenullity.
