    Today it is unanimously recognized that the free development of the human personality represents a supreme value and is the synthetic indicator of the rule of law. This natural state lies in ensuring the fundamental rights and freedoms of man and citizen, constitutionally guaranteed. A special role in these rights and freedoms plays the rights to the “individual freedom and security of the person" condition of his existence protected by the state. In this article we analyze the doctrinal concepts and the normative constitutional regulations on ensuring the right to liberty and security.

    Justice is that ideal state of society, achieved by ensuring for each individual and for all together the satisfaction of their legitimate rights, freedoms and interests.Access to justice is an indispensable condition for promoting and guaranteeing rights and freedoms. It consists in incorporating into the positive law of each country, above all, a regulation of the interests of man, the maximum of justice that the population of the respective country can admit. Access to justice directly indicates the existence of an active obligation on the part of the State to ensure the right to effective legal redress. In order to concretize and give full access to the right of free access to justice, the legislator establishes many other constitutional provisions and develops them, it details them in the organic laws taken as a whole, they become the basis and the basic criterion for the qualification of the rule of law. Freedom of the person is one ofthe oldest rights being inscribed in the ancient and especially medieval texts of normative acts. Article 25 of the Constitution of Romania, entitled "Individual Freedom," Article 25 of the Constitution of the Republic of Moldova, entitled "Individual Freedom and Security", expressly states: "Individual freedom and the security of the individual are inviolable."

    PROPORȚIONALITATEA ÎNTRE MĂSURA PREVENTIVĂ APLICATĂ ȘI GRAVITATEA ACUZAȚIEI

    Este abordată corelația dintre modalitatea măsurilor preventive, condițiile pe care le impune luarea unei măsuri concrete față de persoana acuzată și gradul prejudiciabil al faptei penale incriminate. Autorul subliniază că regula principală care guvernează condițiile în care se poate lua o măsură preventivă este începerea urmăririi penale și punerea sub învinuire a făptuitorului. Astfel conclucă, odată pusă sub învinuire, persoana nu poate fi supusă arbitrar oricărei dintre cele douăsprezece măsuri preventive prevăzute la art. 175 alin.(3) din Codul de procedură penală, dar acelei care este determinată de gravitatea incriminării și proporționalitatea cu circumstanțele individuale ale cauzei penale
