Item Controlul constituționalității legilor retroactive(CEP USM, 2024) Reniță, GheorgheDe regulă, legile au un caracter prospectiv, adică sunt pentru viitor. Totuși, ca excepție, există situații când legile adoptate se referă și la unele situații din trecut. În acest articol se analizează dacă Constituția Republicii Moldova permite adoptarea unor legi retroactive. În acest sens, se face o radiografiere a jurisprudenței Curții Constituționale în materie, precum și a standardelor europene. S-a reținut că principiul neretroactivității legii nu se va încălca în ipoteza adoptării: (I) normelor juridice penale mai favorabile; (II) legilor de interpretare; (III) normele juridice în care legislatorul a stabilit expres că ele se vor aplica retroactiv. Ultimele două ipoteze nu sunt prevăzute expres de Constituția Republicii Moldova, ele au fost deduse pe cale pretoriană.Item Tendințe de europenizare a administrației publice locale(CEP USM, 2024) Kurylo, Inna; Slusarenco, SvetlanaThe status of a candidate country for joining the European Union is an opportunity for the Republic of Moldova to reflect on the progress achieved and to ensure our common commitment to improving and sharing common European values. With a view to joining the European Union and aligning the national regulatory framework with European standards regarding central and local public administration, numerous public policy acts were adopted, which describe the vision, purpose, objectives, actions and resources necessary for the process of transformation/improvement of public administration from the Republic of Moldova at central and local level.
