Item „Complot”: o noțiune aproape uitată în contextul unei infracțiuni noi(CEP USM, 2024) Brînza, Serghei; Stati, VitalieAs a result of a recent amendment, the Criminal Code of the Republic of Moldova was supplemented with art. 3382, which provides liability for the crime of conspiracy against the Republic of Moldova. This crime is highlighted by certain features: 1) it involves an activity aimed at committing other, more serious crimes against state security; 2) this germinal activity is criminalized separately, not in the context of the norms that provide liability for these other crimes against state security. It can thus be noted that, in art. 3382 of the Criminal Code of the Republic of Moldova, the activity of conceiving a crime was equated with a consummated crime.More precisely, in art. 3382 of the Criminal Code of the Republic of Moldova, it is criminalized as a distinct crime either the externalization of the desire to commit one of the crimes provided by the art. 337, 338, 3381 or 3401 of the Criminal Code of the Republic of Moldova, or the preparation of one of these crimes. Finally, it should be noted that the crime, provided by the art. 3382 of the Criminal Code of the Republic of Moldova, is not a crime with a plural subject.Item INFRACȚIUNEA DE COMPLOT ÎMPOTRIVA REPUBLICII MOLDOVA: DIMENSIUNI JURIDICO-PENALE(CEP USM, 2023) Brînza, Serghei; Stati, VitalieÎn cadrul prezentului studiu științific este analizată pentru prima dată infracțiunea de complot împotriva Republicii Moldova, prevăzută de art. 3382 din Codul penal al Republicii Moldova. Sunt interpretate prevederile acestui articol și stabilite condițiile în care se aplică răspunderea penală pentru complotul împotriva Republicii Moldova. Sunt identifica- te particularitățile ce caracterizează modalitățile normative ale acțiunii prejudiciabile prevăzute la art. 3382 din Codul pe- nal al Republicii Moldova. Este stabilită relația dintre acest articol, pe de o parte, și art. 324, 328, 333, 337, 338, 3381 și 3401 din Codul penal al Republicii Moldova, pe de altă parte. Autorii speră că rezultatele, obținute în cadrul investigației de față, vor impulsiona și vor înlesni aplicarea în practică a art. 3382 din Codul penal al Republicii Moldova.
