Item Egalitatea în drepturi. discriminarea pe criteriul “limbă”(2024) Sfătoiu, MihaelaItem CONSTITUȚIONALIZAREA PRINCIPIULUI LOIALITĂȚII CONSTITUȚIONALE(CEP USM, 2022-03-17) Sfătoiu, Mihaela; Cârnaț, TeodorThe principle of constitutional loyalty is of interest both nationally and internationally, since loyalty to the values, rules and principles set out in the Constitution must be, both in theory and in practice, a very solid connectivity element in the relations between the various public authorities. In Romania, the principle of constitutional loyalty is not expressly mentioned in the Constitution. The Constitutional Court of Romania has deductively interpreted the obligation of constitutional loyalty from a principle expressly provided for in the Fundamental Law – the separation and balance of powers in the state. Nor does the Constitution of the Republic of Moldova contain express provisions of this principle. Its treatment brings into question the existence of the “constitutionality bloc” in the Republic of Moldova.Item COMUNITATEA DE LIMBĂ(CEP USM, 2021-12-08) Sfătoiu, MihaelaLanguage, regarded as a distinctive social element for the individual, has two-hu- man, antagonistic valences. On the one hand, it is a unifying factor for human communiti- es, at the heart of the nation. Viewed from another angle, the language can be a separator element when it is specific to a minority group. Thus, the present work analyzes the way in which the language community of individuals determines the formation of linguistic nations and minorities, as well as the way in which the protection of constitutional rights and freedoms of citizens of any nationality, who live on the territory of the Republic of Moldova, regardless of the language they speak, under the conditions of equality of all citizens and with respect for the right to linguistic identity, is ensured.
