Item LA DEFINITION INCERTAINE DU CONSOMMATEUR EN DROIT FRANÇAIS(2014) Plotnic, OleseaPlus on étend le cercle des bénéficiaires de la protection, moins la protection apparait forte et la loi de protection des consommateurs devient le nouveau droit de consommation en remplacement du droit civil. Plus la définition retenue sera étroite, plus le caractère protecteur de ces dispositions sortira renforcé, de même que le caractère d'exception du droit de la consommation; plus, au contraire, la définition sera large, moins le caractère protecteur de ce droit sera mis en valeur, ceux s'en trouvant exclus apparaissant alors soumis à un statut spécial, comme par inversion du principe et de l'exception.Item LES DÉBATS ENTRE LE DROIT COMMUNAUTAIRE, MOLDAVE ET FRANÇAIS CONCERNANT LE STATUT DU CONSOMMATEUR EN QUALITE DE PERSONNE MORALE(2013) Plotnic, Olesea; Băieșu, AurelThe economy consumer contracts, determining legal subjects report the consumption of primary importance because the very applicability of the specific consumption norms depends on the qualification of special topics as consumer reports consumer and trader. Although at a first analysis , the identification of these subjects does not seem to make any special problems under title proposed for research, case law proves otherwise. In Moldova, the participants in consumer relations are classified into consumers and businesses. The article examines issues relating to consumer status as a legal person in private international law. The present study aims to analyze the parties to the contract principle of inequality of consumption and to investigate the possibility of providing consumer corporate status .
