It is an absolute principle, which means that it cannot be limited by the state. Free access to justice must be guaranteed to all the people, in an equal, impartial and non-discriminatory way, regardless of their quality (citizen, foreigner or stateless person), race, nationality, religion, political affiliation, sex, wealth etc. A genuine rule of law necessarily implies the possibility of every person to defend his rights, freedoms and legitimate interests provided by the Constitution and the national law in force. This supreme purpose of the state is achievable due to this absolute fundamental principle – free access to both common law and constitutional justice.Item STATUTUL DEȚINUTULUI PRIN PRISMA PRINCIPIULUI UNIVERSALITĂȚII(Tipografia Artpoligraf, 2019) Arseni, Alexandru; Panchiv, OleseaAccording to the legal provisions contained in international and national normative acts, the fundamental human rights and freedoms are guaranteed to everyone in a fair, impartial and non-discriminatory way. However, there are certain categories of people who have their rights and dignity badly affected, for instance, the detainees. The present article aims to analyze the situation in the penitentiary system of the Republic of Moldova emphasizing the main issues related to the conditions of detention and treatment of the individuals held in prisons and police temporary detention isolators, such as physical illtreatment, poor state of hygiene and health-care services, overcrowding etc. The allegations received from the detainees represent the primary source which reports a set of serious violations and deviations from the respect for fundamental human rights. The competent authorities of the state, as well as the civil society must be directly involved in solving the identified problems in order to transpose the provisions of the legal framework into life and build an eminently democratic state based on the rule of law and the guarantee of fundamental human rights.
