Public confidence in the act of justice also depends to a large extent on the effectiveness of enforcement mechanisms, and it is absolutely necessary that a court decision obtained following a judicial procedure, often lengthy and costly, has a practical purpose, so that the litigant is aware of the benefits of obtaining a positive outcome in the process. Otherwise, in the absence of coherent, clear, flexible and expeditious procedural means to ensure that the enforceable title is effectively enforced, the party would be unable to enjoy the proceedings, the enforceable title thus conferring on the creditor only a right theoretically and illusory.
