Statutul juridic al aleșilor locali

The article contains a brief analysis of the legislation in force governing the legal status of local elected representatives. After identifying the circle of officials who make up the category of local elected representatives, it is argued which of them are elected by local authorities and which by local authorities, thus making a clear distinction between these two subcategories. At the same time, the public official status of local elected representatives is analysed, and it is noted that most of them, according to the legislation in force, exercise functions of public dignity, with the exception of councillors (who form local councils). Given that councillors cannot be recognised as public officials, it is argued that the legislation should be amended to expressly recognise their status as elected dignitaries (persons holding positions of public dignity).

The study is devoted to the analysis of the people’s elected officials as a distinct category of public servants of the state. Starting from the notions of public function, civil servant, public dignity and person holding a public dignity function, it is realizing a clear delimitation of public officials from civil servants, as well as dignitaries elected by the appointed dignitaries.
