    Barierele utilizării medierii în Republica Moldova

    The implementation of mediation in the Moldova Republic faces significant barriers, both subjective and objective. Subjectively, the low level of legal awareness among citizens limits their understanding, respect and acceptance of mediation’s benefits. Objectively, the lack of an enabling system, a rather incoherent and unstable legislative framework, as well as insufficient regulations for mediators hinder effective mediation. Financial barriers, such as high office costs for mediators and low income, also discourage the practice. Additionally, insufficient promotion and the absence of a unified mediator community further diminish public trust and utilization of mediation. Overcoming these challenges requires comprehensive measures, including public education, legislative reforms, and financial support for mediators, to make mediation a viable and efficient method of dispute resolution in Moldova.

    Asigurarea respectării interesului superior al copilului în procedura de mediere

    Mediation is an alternative method of settling disputes amicably in a structured, flexible and confidential process with the assistance of one or more mediators. The mediator is a third party specialised in dispute resolution who facilitates negotiations between the parties. The legislation regarding mediation regulates the way the mediation process is carried out, so that the best interest of the child is ensured. Mediation has numerous legal, economic, social and psychological advantages, compared to other ways of resolving disputes. Due to its numerous advantages, mediation is the most appropriate way of resolving conflicts in which children are involved, especially family disputes and criminal conflicts.
