    Subiectul infracțiunii prevăzute la art. 220 Cod Penal al Republicii Moldova [Articol]

    În studiul de față se examinează subiectul infracțiunii prevăzute la art. 220 Cod Penal al Republicii Moldova. Astfel, se arată că în condițiile alin. (1) art. 220 CP RM, subiect al infracțiunii este persoana fizică responsabilă care a atins vârsta de 16 ani. De asemenea, sunt clarificate unele disensiuni teoretice pe baza noțiunii de „subiect al infracțiunii”. Se relevă faptul că lipsa oricărui semn obligatoriu ce caracterizează subiectul infracțiunii, atestă lipsa subiectului infracțiunii și, prin urmare, a componenței de infracțiune. În cele din urmă este abordată prevederea de la lit. d) alin. (2) art. 220 CP RM, în ipoteza căreia subiectul infracțiunii de proxenetism are calitatea specială de persoană publică, persoană cu funcție de răspundere, persoană cu funcție de demnitate publică, persoană publică străină sau funcționar internațional.

    Unele aspecte privind victima infracțiunii de proxenitism [Articol]

    In the present scientific research, we analyse the victim of the pimping crime from the perspective of criminal law. We found that in case of pimping offences as a victim can evolve both: woman and man. Thus, the particularities of the victim do not imply importance in the qualification of the deed, except of the hypothesis provided in l. b) para. (2) art. 220 Criminal Code of the Republic of Moldova – pimping committed on a pregnant woman. At the same time, we elucidated the significance of the victim’s assent to the legal classification of the deed based on art. 220 of the Criminal Code of the Republic of Moldova and we formulated some proposals of lex ferenda. In the present research we referred to the criminal laws of other states.

    Reglementarea răspunderii pentru proxenetism: aspecte de drept comparat [Articol]

    In this study, the crime of pimping specified in art. 220 of the Criminal code of Republic of Moldova is subjected to comparative analysis with similar offenses provided in the criminal laws of some foreign states. In this way, the similarities and differences of the examined offenses are discussed. Considering the legislative experience of the foreign states, in order to improve the national provisions regarding the examined crime, it was proposed to insert a new letter in paragraph (2) of art. 220 of Criminal Code of Republic of Moldova, with the aggravating circumstance „on a minor”.

    Obiectul juridic al infracțiunii de proxenetism [Articol]

    In this study is analyzed the legal object of the crime of pimping specified in art.220 of Criminal code of Republic of Moldova. In the context of examining the generic legal object of the crime of pimping, the author makes a foray into the criminal law of several states, systematizing the regulations analyzed in three different perspectives. At the same time, the author attests a lack of doctrinal consensus on the special legal object of pimping. Finally, the author invokes arguments regarding the need to delimit the author invokes arguments regarding the need to delimit the generic legal object from the special legal object of pimping and considers it superfluous to designate social relations regarding human dignity as a special legal object of the crime provided in art.220 CP RM.
