    К толкованию пределов применения Уголовного Кодекса Республики Молдова в области противодействия экстремистской деятельности

    Целью данной научной статьи является решение проблем правоприменения в области борьбы с экстремистской деятельностью (словесной или физической) в действующем законодательстве Республики Молдова, указание пределов ответственности за преступления и правонарушения, предусмотренные Уголовным Kодексом и Кодексом о Правонарушениях Республики Молдова соответственно. В результате проведенного научного исследования в области противодействия экстремизму были предприняты следующие шаги: выявлена и типологизирована экстремистская деятельность путем сопоставления положений Закона Республики Молдова № 54/2003, с одной стороны, и Кодекса о Правонарушениях и Уголовного Kодекса Республики Молдова, с другой; аргументировано взаимодействие мотива предрассудка и экстремистского мотива, где предрассудок служит основой для радикализма, экстремизма и даже терроризма; сформулированы выводы и рекомендации, направленные на совершенствование правовой доктрины и современного законодательства.

    Уголовно-правовой и криминологический анализ экстремизма и терроризма

    In the realm of this scientific research there is performed a profound analysis of criminological points of view as well as of penal provisions concerning some aspects of extremism and terrorism from the perspective of its impact upon the content of the penal prohibitions which are contained in the General and Special parts of The Criminal code of the Republic of Moldova. In order to obtain the best scientific results, there have been examined such phenomena as fanatic views, fundamentalist views, as well as there have been researched extremism and terrorism. This report can be defined as an analysis of the modern penal and criminological doctrine, as well as some results of the sociological science which gives the opportunity to consider that this is an interdisciplinary research. There is demonstrated that as a basic sign of the delimitation between extremist offences and other types must be recognized the criminal reason of the misdeed. As a result, there have been formulated several conclusions which can be applied in the science of the Substantive Criminal Law, Criminology, as well as can be taken into account during the improvement of the penal legislation.

    ПРЕДУПРЕЖДЕНИЕ ИНФОРМАЦИОННОЙ ДЕСТРУКТИВНОЙ ПРОПАГАНДЫ В КРУГУ МОЛОДЕЖИ: АСПЕКТЫ КРИМИНОЛОГИИ И ПСИХОЛИНГВИСТИКИ

    Most of all, destructive propaganda (of extremist and terrorist persuasion) affects people whose mental state is more vulnerable and receptive. Children and adolescents are more easily amenable to destructive influence on their own yet unformed worldview. The young man is fascinated by the search for the meaning of life and the significance of participating in polar activities, saturated with potential risk, without realizing the true consequences of his involvement in extremist activities. Any uncontrolled religious and political doctrine goes through the following stages from “harmless” fanaticism, as a kind of philosophical and religious intoxication of the individual himself, to religious and political terrorism with an extensive system of accomplices and followers, whose activities can destroy public institutions, lead to death of people and entail other serious effects. So, in descending order, we outline five stages of philosophical or religious-political intoxication, which goes through any individual who has delved into the study of certain religious or philosophical ideas: ordinary religiosity or enthusiasm for philosophical and political teachings; fanaticism; fundamentalism; extremism; terrorism. Propaganda materials are characterized by a creative idea and the use of psycholinguistics and marketing techniques. The information is radical, subjective and tendentious in nature, the final goal of which is to recruit the user. From a criminological and psycholinguistic point of view, the prevention of destructive propaganda among young people comes down to a conscious choice and selectivity of visiting Internet resources and consuming information presented in the public domain.

    ФЕНОМЕН ПРОПАГАНДЫ В ТРАКТОВКЕ СОВРЕМЕННОЙ КРИМИНОЛОГИЧЕСКОЙ НАУКИ И ПСИХОЛИНГВИСТИКИ

    Nowadays, propaganda, as a stable comprehensive and proven method of influencing the minds of people, is becoming the subject of scientific research, both in criminological science and in psycholinguistics. In the presented article, an attempt was made in order to systematize modern interpretations of such a concept as ‘propaganda’, which is important not only in the process of studying the causes and conditions for committing crimes in the media space (television, radio, Internet content, publishing printed media, etc.), but also for the subsequent development of measures of identifying and preventing cases of the use of destructive propaganda based on the abuse of psycholinguistic techniques for negative influence upon people’s mind and upon their system of moral values and basic instincts.
