Abstract
Dreptul de superficie îşi trage originea din Dreptul privat roman, graţie cărui fapt există multe asemănări între reglementările
din legislaţia ţărilor Europei continentale. La ora actuală există două concepte relative la dreptul de superficie.
Unul dintre ele constă în aceea că proprietarul terenului devine prin accesiune şi proprietar al construcţiei, instalaţiei sau
plantaţiei efectuate pe sau sub teren. Acest concept îl împărtăşeşte legislaţia Germaniei şi a Republicii Moldova. Al doilea
concept constă în recunoaşterea dreptului de proprietate al superficiarului asupra construcţiei, instalaţiei sau plantaţiei şi
dreptul de proprietate al altei persoane asupra terenului pe sau sub care acestea se află. Cel de-al doilea concept este preluat
de legislaţia şi doctrina majorităţii absolute a ţărilor Europei continentale.
The right of superficies originates from Roman private law, due to this fact there are many similarities between the law regulations of continental European countries. Currently there are two concepts related to the right of superficies. One of them, consisting in the fact that the landowner becomes through accession also the owner of the construction, installation or plantation carried on or under the land. This concept is shared by the law of Germany and the Republic of Moldova. The second concept consists in the recognition of the ownership of the superficiary over the construc tion, installation or plantation and the ownership of another person over the land on or under which these are located. The second concept is taken over by the law and doctrine of the continental European countries.
