CORELAȚIA DINTRE PRINCIPIUL PROPORȚIONALITĂȚII ȘI UNELE PRINCIPII FUNDAMENTALE

Abstract

În acest articol este analizată corelația dintre principiul proporționalității și unele principii fundamentale. În special, s-a avut în vedere stabilirea corelației dintre principiul proporționalității și principiul legalității, principiul subsidiarităţii, principiul oficialității, precum și principiul respectării drepturilor, libertăților și demnității umane. În urma studiului efectuat s-a ajuns la concluzia că principiul proporționalității are conexiuni cu toate principiile menționate și că are o pondere decisivă atunci când se stabilește echilibrul corect dintre interesul public și interesul particular.This article examines the correlation between the principle of proportionality and some fundamental principles. In particular, consideration was given to establishing the correlation between the principle of proportionality and the principle of legality, the principle of subsidiarity, the principle of officiality, and the principle of respect for human rights, freedoms and dignity. Following the study, we came to the conclusion that it has connections with all the mentioned principles and that it has a decisive weight when establishing the right balance between the public interest and the private interest.
