LATURA SUBIECTIVĂ A INFRACŢIUNILOR VAMALE POTRIVIT LEGISLAŢIEI REPUBLICII MOLDOVA

Abstract

În cadrul studiului întreprins este supusă investigaţiei latura subiectivăa infracţiunilor prevăzute la art.248 şi 249 CP RM (infracţiunile de contrabandăşi cele de eschivare de la achitarea plăţilor vamale). Se argumentează că infracţiunile vamale pot fi comise doar cu intenţie directă. În acela şi timp, se demonstrează că eschivarea de la achitarea plăţilor vamale este comisăn cu un scop special, acesta constituind semn obligatoriu al componenţ ei de infracţiune. Se arată că pentru a fi în prezenţa contrabandei prelungite este necesar ca făptuitorul să manifeste o intenţie unică, dublată de un scop unic, faţă de toate acţiunile infracţionale comise.

In the study conducted is investigated subjective side of offenses mentioned in art.248 and 249 PC RM (crimes of smuggling and the evasion of customs payments). It is argued that customs offenses can be committed only with direct intention. At the same time, it is demonstrates that the ev asion of customs payments is committed with special purpose, this being mandatory sign of a crime. It shows that to be in the presence of prolonged smuggling it is necessary that the perpetrator to manifest single intention, coupled with a unique purpose, to all committed criminal actions.
