CESIUNEA DREPTULUI SUBIECTIV DE IPOTECĂ

Abstract

In the result of the principle that the patrimonial rights are dismissible, with the exception of the cases foreseen by the law, the cessation of the subjective hypothecary right can be carried out. The cessation of the subjective hypothecary right represents a mechanism of indirect implementation of liabilities by the hypothecary creancer, but this mechanism has to be settled in a clear, adequate and correct form. The present article is dedicated to the analysis of the regulations of the legislation of Republic of Moldova concerning the cessation of the subjective hypothecary right.
