Iidentitatea ca un drept al omului contemporan: o analiză filosofică [Articol]

Abstract

Modern liberal society increasingly formulates its aspirations in terms of a «right to identity», reinforcing the need to introduce this concept into the corpus of legal categories. Nevertheless, this is not a straightforward operation, as its philosophical foundations are still insufficiently explored. For this reason, the paper aims to carry out a philosophical analysis of the concept of «right to identity». In order to achieve the goal, we have defined the tasks that have been consistently implemented in the structure of the article: at the beginning was defined the essence of the concepts of «identity», «right to identity» and «right»; then their contents were correlated. The results of this conceptual analysis can be divided into two groups: first, the internal contradictions of the claim of «right to identity» and second, the contradictions between the concepts of «identity» and «right». As it seeks to recognize a certain uniqueness of the subject of law, the demand for a right to identity contradicts related philosophical legal concepts: it does not take into account the specificity of the language of law, the subject of law, the essence of the concept of «identity», the prior legal tradition and finally liberalism, from which it is derived.

Societatea liberală contemporană tot mai mult își formulează dorințele sale în termenii unui «drept la identitate», ce întărește necesitatea de a introduce acest concept în corpul de categorii juridice. Totuși, această operațiune nu este simplă, deoarece baza sa filosofică încă nu este destul de explorată. Din acest motiv, scopul acestui articol este de a realiza o analiză filosofică a conceptului de «drept la identitate». Pentru atingerea obiectivului am identificat următoarele sarcini care au fost implementate în mod consecvent în structura lucrării: în primul rând, a fost definită esența conceptelor de «identitate», «drept la identitate» și «drept», apoi au fost corelate conținuturile lor. Am împărțit rezultatele obținute în două grupuri de concluzii: primul grup contradicțiile interne ale conceptului de «dreptul la identitate», al doilea grup contradicțiile dintre conceptele de «identitate» și «drept». Fiind о dorință de a recunoaște unicitatea a subiectului de drept, revendicarea dreptului la identitate contrazice conceptele filosofice și juridice conexe: nu ține cont de specificitatea limbajului juridic, subiectului de drept, esenței identitatălii, tradiția juridică anterioară și, în cele din urmă, liberalismul din care derivă.
