VICTIMA INFRACȚIUNILOR PREVĂZUTE LA art.259 DIN CODUL PENAL

Abstract

În acest studiu sunt stabilite caracteristicile pe care le posedă victima infracțiunilor prevăzute la art.259 CP RM. Se argumentează că sintagma „subiectul pasiv al infracțiunii” nu este aplicabilă în raport cu această victimă. Se relevă de ce statul nu poate avea calitatea de victimă a infracțiunilor prevăzute la art.259 CP RM. Se arată că victima în cauză este participantă la relațiile sociale apărate împotriva infracțiunilor prevăzute la art.259 CP RM: 1) relaţiile sociale cu privire la accesul autorizat sau permis la informaţia computerizată și/sau 2) relaţiile sociale cu privire la integritatea, autenticitatea, disponibilitatea sau ireproductibilitatea informației computerizate ori funcționalitatea calculatoarelor, a sistemului sau a reţelei informatice, apărate împotriva cauzării de: 1) daune în proporții mari (în cazul infracțiunii prevăzute la alin.(1)); 2) daune în proporții deosebit de mari (în cazul infracțiunii prevăzute la lit.h) alin.(2)).In this study, the characteristics of the victim of the offenses provided in art.259 of the Criminal Code of the Republic of Moldova are established. It is argued that the syntagma “passive subject of the crime” is not applicable in relation to this victim. It is revealed why the state cannot have the quality of a victim of the offenses provided in art.259 of the Criminal Code of the Republic of Moldova. It is demonstrated that the victim in question is a participant in the social relations defended against the offenses provided in art.259 of the Criminal Code of the Republic of Moldova: 1) social relations regarding the authorized or allowed access to computerized information and/or 2) social relations regarding the integrity, authenticity, availability or irreproducibility of computerized information or the functionality of computers, computer system or computer network, defended against causing: a) damage on a large scale (in the case of the offense provided for in para.(1)); b) damage on an especially large scale (in the case of the offense provided in let.h) para.(2)).
