UNITATEA PUTERII DE STAT: CONTROVERSE ŞI REALITĂŢI

Abstract

În prezentul articol, sunt elucidate subiecte controversate ale teoriei generale a dreptului şi dreptului constituţional. Utilizarea conceptelor teoretice şi confruntarea lor cu realităţile practice contemporane permit soluţionarea acestor divergenţe în sensul stabilirii relaţiei de compatibilitate între principiile unităţii puterii de stat şi cel al separaţiei puterilor.

In the present article there are elucidated controversial subjects of the general law theory and constitutional law. The use of theoretical concepts and their confrontation with the contemporary practices permit the solving of these divergences in order to establish the compatibility relationship between the principles of state power unity and of powers separation as well.
