APĂRAREA DREPTURILOR, LIBERTĂȚILOR ȘI INTERESELOR ALTOR PERSOANE DE CĂTRE AUTORITĂȚILE PUBLICE, ORGANIZAȚII ŞI CETĂŢENI

Abstract

În acest articol sunt abordate conceptele privind participarea la proces a autorităților publice, a organizatiilor și cetățenilor pentru apararea drepturilor, libertăților și intereselor altor persoane. Sunt evidențiate condițiile în baza cărora, potrivit art.73 alin.(1) CPC RM, în cazurile prevăzute de lege, autoritățile publice, organizațiile, persoanele fizice pot adresa în judecată acțiune (cerere) în apărarea drepturilor, libertăților și intereselor legitime ale unor altor persoane, la cererea acestora sau în apărarea drepturilor, libertăților și intereselor legitime ale unui număr nelimitat de persoane fizice. Iar în conformitate cu principiul disponibilității, procesul civil poate fi pornit în apărarea drepturilor și intereselor legitime numai de persoana interesată – subiect al raportului material litigios.

In this article, the concepts regarding the participation in the process of public authorities of organizations and citizens for the defense of the rights, freedoms and interests of other persons are approached. The conditions under which, according to art.73 para.(1) CCP RM in the cases provided by law, public authorities, organizations, individuals may sue (claim) in defense of the rights, freedoms and legitimate interests of other persons, at their request or in defense of the rights, freedoms and legitimate interests of an unlimited number of individuals, are highlighted. Moreover, in accordance with the principle of availability, civil proceedings can be started in defense of legitimate rights and interests only by the interested person – the subject of the material dispute report.
