Funcţiile și atribuţiile Președintelui Republici Moldova prin prisma jurisprudenţei Curţii Constituţionale a Republicii Moldova

Abstract

The institution of the president, especially the person of the head of state, has played, since ancient times, the defining role in the organization and functioning of any collective/community. In the context of the importance of the institution of the head of state in the system of central public authorities, and also taking into account the political regime from the perspective of the need to ensure the separation of powers in the state, particular importance is given to the determination of the functions and the establishment of the powers of the President, which, in the end, conditions the legal nature of the political system and the constitutional configuration of government. The functions and powers of the President are determined by factors, such as: the way of appointing the head of state, the relations between the legislative and the executive power, the constitutional checks and balances mechanism to ensure the balance between the state institutions, namely: Parliament-Government, Parliament President, President-Government and in relation to the judicial authority.

Instituţia președintelui, mai cu seamă persoana șefului statului, a jucat, din cele mai vechi timpuri, rolul defi nitoriu în organizarea și funcţionarea oricărei colectivităţi/comunităţi. În contextul importanţei instituţiei șefului statului în sistemul autorităţilor publice centrale, dar și ţinând cont de regimul politic din perspectiva necesităţii asigurării separaţiei puterilor în stat, o însemnătate deosebită o capătă determinarea funcţiilor și stabilirea atribuţiilor Președintelui, care, într-un fi nal, condiţionează natura juridică a sistemului politic și confi guraţia constituţională de guvernământ. Funcţiile și atribuţiile Președintelui sunt determinate de factori precum: modul de desemnare a șefului statului, raporturile dintre puterea legislativă și cea executivă, mecanismul constituţional de frâne și contrabalanţe pentru asigurarea echilibrului între instituţiile statului, și anume: Parlament-Guvern, Parlament-Președinte, Președinte-Guvern și în raport cu autoritatea judiciară.
