PROBLEME ȘI SOLUŢII ÎN REALIZAREA DREPTULUI APĂRĂTORULUI DE A ADMNISTRA PROBA CU MARTORI

Abstract

Este luat în dezbateri unul dintre cele mai importante aspecte ale activităţii apărătorului – dreptul de a propune şi a invoca proba cu martori. Se porneşte de la importanţa declaraţiilor martorului pentru rezolvarea cauzei penale şi se susţine întemeiat că respectivul mijloc de probă este cel mai des utilizat în practica judiciară, inclusiv în scopul apărării.Sunt identificate soluţii prin care apărătorul poate obţine administrarea declaraţiilor martorilor apărării. Miezul discuţiilor este prevederea de la art.100 alin. (2) pct.1) din Codul de procedură penală, potrivit căreia apărătorul admis în procesul penal este în drept să poarte convorbiri cu persoane fizice, dacă acestea sunt de acord să fie audiate în modul stabilit de lege.

It is debated one of the most important aspects of the defender’s activity - the right to call and invoke witnesses. The article starts with the importance of the witness’s statements for solving the criminal case and claims that this means of evidence it is the most frequently used in judicial practice, including for the purpose of defense.There are identified solutions by which the defender can obtain the administration of the statements of the witnesses.The core of the discussions is the provision from Article 100, paragraph 2, point 1, of the Code of Criminal Procedure, according to which, the defender admitted in the criminal process is entitled to have talks with witnesses, if they agree to be heard in the manner established by law.
